Terms of this Membership and Service Purchaser Agreement


Birth Like a Boss is the trading name of Epical Global Ltd. All content and products are owned and provided by Epical Global Ltd (“Company” or “we” or “us” or “our”). The term “you” or “your” refers to any user or purchaser of said membership, course(s), products(s) or Services. These Terms and Conditions of Use (“Terms”) govern and define how you are allowed to use and access the Company’s Membership Content and other related Services. We reserve the right to update and change these Terms at any time, and will update them accordingly with the ‘date last updated’ at the top of this page.


You are legally bound to these Terms whether or not you have read them. If you do not agree with any of our Terms, please email us at enquiries@epicalglobal.com and we will make reasonable efforts to remove your name, email and access to our Membership, website(s) and/or Platform(s).

 

It is important that you take the time to read these terms and conditions, and associated policies, with particular attention to our Privacy Policy which can be found here.


Whilst our virtual consultations are undertaken by a trained midwife or other healthcare professional and we do our best to ensure that all the information and advice that we share is based on the most up to date evidence available it cannot, and should not, be seen as an appropriate substitute for a careful and respectful appraisal of the unique and holistic needs of you as an individual and your own personal circumstances.


Services provided by Epical Global Ltd should NOT be used in possible emergencies or in any situation that may require urgent medical attention.  If you think that your situation is, or might become, an emergency, you should seek IMMEDIATE care using the emergency services in your area.

  1. Who we are and how to contact us.

The services are provided by Epical Global Ltd, trading as Birth Like a Boss. www.birth-like-a-boss.com is a site operated by Epical Global Ltd. Epical Global utilises third party platform(s) for our virtual consultation services and to host our Membership site which is the platform for our content service.


These Terms govern the use of all of the third party platforms, and associated website(s). Please read these Terms carefully and make sure you understand them. You will need to accept these Terms as part of the Platform(s) registration process. If you do not accept these Terms, you will not be able to register to use the Platform(s) and consequently will not be able to access any of the Services.


Please note that, where your use of our Services has been paid for by your employer under the terms and conditions that we have entered into with them, you will be required to accept these Terms and you understand that your use of our Services will not be accepted on these Terms where:


  • You are no longer an employee of the employer who we have entered into a contract with.
  • You have already used the number of Consultations covered by your employer’s subscription and your employer has not agree to cover your further use of the Services
  • The contract with your employer has come to an end.


If you would like to continue to access the Services you will then be required to pay the fees as set out in these Terms.

  1. Our Responsibilities

Our aim is to provide women with easy access to safe virtual midwifery care utilising technologies where appropriate to do so, at times that are convenient and accessible to women and their families.

In order to provide our Services we have identified our responsibilities, laid out below but there are however important limitations to the care that we can provide:

 

  1. We will undertake our virtual consultation services with reasonable care and skill.
  2. We will endeavour to provide a midwife from your country of residence but where this is not available we do not take responsibility for any variations in healthcare regulations and guidelines.
  3. We will ensure that our midwives, and associated healthcare professionals, will remain as up to date as possible and provide you with the most evidenced based information that we have available, but we do NOT act as a substitute for specific medical advice from your maternity care provider.
  4. The advice that we provide to you is based on the information that you have shared and any associated record keeping can only be viewed by you and will not be shared with any other provider. However, if there is risk of yourself or someone else being harmed or other unlawful activity, we may have to pass some details onto the authorities.
  5. Our Services are not suitable to be used in medical emergencies. If you think that your situation is, or might become, an emergency, you should seek IMMEDIATE care using the emergency services in your area.
  6. Our Services are not suitable where a physical examination is necessary. Epical Global does not provide blood testing or medication and is limited to providing symptomatic or therapeutic advice virtually that can be carried out by a midwife or associated healthcare professional.
  7. You must be aged 18 or over to register and use the Platform(s) and access the Services.
  8. When you are using the virtual consultation service do not transmit any unlawful, threatening, libellous, defamatory or any material that could constitute or encourage conduct that would be considered a criminal offence or violate the law.

 

  1. The Services that we provide

Epical Global provides a virtual midwifery telehealth service designed to support women with symptomatic or therapeutic advice, which can be undertaken by video, telephone, live chat or email, through designated third party secure platform(s). We can also provide you with access to any records that we hold.


Our Services should NOT be used in a medical emergency or in any situation where a physical examination is necessary.

The Services are not intended to replace your existing maternity care provider and should only be used to complement your current service provision. On this note we strongly recommend that you discuss the use of our services with your existing care provider.



  1. Geographical Locations

The Service(s) are available to women anywhere in the world and we will endeavour to ensure that the virtual midwifery care service is provided by a midwife registered in your country of residence so as to comply with the relevant healthcare regulations and guidelines.

Accordingly, this may not always be possible, and if a midwife is providing virtual advice from outside of your country of residence we do not take any responsibility for any variations in healthcare regulations and guidelines, but we do endeavour that ALL of our advice is based on the most up to date evidence available.


Epical Global accepts no responsibility for access to our Platform(s) or use of our Services in a country where such activities are unlawful or restricted in any way.


  1. Platform(s) Registration Requirements

The Platform(s) and Services are for use by women aged 18 and over. Epical Global does not provide any Services to children aged under the age of 18.


We can only provide our virtual midwifery services in accordance with these Terms if you provide us with accurate information so that we can support you with personalised evidence based advice. In order for us to do so you must ensure that:


  • Any information you provide is accurate and given in good faith, as well as being provided in English (unless otherwise agreed)
  • If you have any concerns about the Services that we provide to you that you will seek further medical advice from your chosen care provider or other medical professional.
  • You follow any advice or instructions given to you, including onward referral or recommendations to see your care provider, or with the use of any technologies that we recommend, such as fetal dopplers, BP monitoring machines, breast pumps.
  • You report any adverse or unexpected effects of any treatments we have recommended to the person who recommended it.
  • You report any changes in your circumstances, including any changes in your medical condition.

Please ensure that you only register once on the relevant Platform for any of our Services to enable us to keep contemporaneous and accurate records for you.


  1. Ongoing access to the Platform(s)

Epical Global cannot guarantee that your access to any of the third party Platform(s) or any content, will be free of interruption, errors or omissions. However, we will use all reasonable skill and care to avoid any such interruptions, unavailability, errors or omissions by having chosen ‘the best in market Platform providers’ and appropriate contractual, performance, security and quality controls in place.


You are responsible for ensuring that you have all the appropriate hardware and software, as well as sufficient internet bandwidth needed in order to access the Platform(s).


You are only permitted to access the Platform(s) and use the Services for your own personal use. You must not use the Services for any commercial or business purpose.


  1. Restrictions on use of the Platform(s)

You must:


  1. Not use the Platform(s) or our services in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses or harmful data, into any of the third party Platform(s) or operating systems.
  2. Not infringe our intellectual property rights or those of any third party in relation to your use of the Platform(s) or Services (to the extent that such use is not licensed by these Terms).
  3. Not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the Platform(s) or Services.
  4. Not use the Platform(s) or Services in any way that could damage, disable, overburden, impair or compromise any systems or security or interfere with other users.
  5. Not collect or harvest any information or data from any Services or our systems or attempt to decipher any transmissions to or from any of the servers running the Platform(s).


You agree that you will:


  1. Not rent, lease, sub-license, loan, provide or otherwise make available, the Platform(s) or Services in any form, in whole or in part to any person without prior written consent from us.
  2. Not copy any part of the Platform(s) or Services, except as part of the normal use of the Services or where it is necessary for the purpose of back up or operational security.
  3. Not translate, merge, adapt, vary, alter or modify, the whole or any part of the Platform(s) or the Services or any part of them to be combined with, or become incorporated in, any other programs, except as necessary to use the Platform(s) and the Services on devices as permitted in these Terms.


Under the Terms of this agreement we are giving you personally the right to use the Platform(s) and the Services. You may not otherwise transfer the Platform(s) or the Service to someone else, whether for money, for anything else or for free. If you sell any device on which you have registered the Platform(s) you must remove any link to the registration from the device.


  1. We may make changes to our Membership site (content)

From time to time we may automatically make changes to our Membership Site and or Services to improve performance, enhance functionality, to reflect changes implemented by third party providers to the operating systems or to address security issues. Alternatively, we may ask you to update the Platform(s) for these reasons.


If you have received a request to install updates and if you choose to opt out of any such updates you may not be able to continue to use the Platform(s) or the Services.


  1. Account Safety

If you choose, or you are provided with, user identification codes, passwords or any other piece of information as part of the security features of any of the Platform(s), you must treat such information as confidential and you must not disclose it to any third party.


We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.


If you believe, or know, that your security has been compromised you must make every effort to change your code or password immediately and notify us at enquiries@epicalglobal.com


  1. Intellectual Property

All images, text, designs, graphics, page layout, icons, videos, logos, taglines, trademarks and service marks are owned by, and the property of Epical Global Ltd or the properly attributed party. It is a violation to use any of our intellectual property in whole or in part, and modification of any materials contained or provided in the Membership site, courses and/or in relation to the Services, is illegal and may be prosecuted to the fullest extent permissible should we choose to do so, including seeking financial penalties (damages) and/or an injunction forcing you to stop using our intellectual property immediately.

Access the content for your individual use.

Download and/or print any Course materials for your individual use

Use our trademarks and copyrighted materials with our prior written consent and proper credit and marking, namely, citing ©Birth Like a Boss as the source of the materials and marking any federally registered trademarks with ® or common law trademarks with ™. 

You​ ​may​ ​not: 
Re-sell or trade your access to the Membership site, Course(s) or Services; 
Share the membership or course materials with anyone else who has not yet purchased it or opted to receive it; 
Reprint any portion of the Content, except as set forth above and for your own individual use;
Republish any of the Content, in part or in whole; 
Distribute any of the materials contained in the Membership or related materials and/or communications as your own; 
Reproduce and alter any part or whole of the Course(s) or content for distribution as your own work; 
Claim ownership or use over any of our intellectual property without our prior written consent, which includes (but is not limited to): copyrights such as course materials, worksheets, workbooks, lessons, videos and more; trademarks such as names, logos, tag-lines or other unique source identifiers; or trade dress including the look and feel of the Course (and its related communications and materials); 
Use our Course or any related materials and/or communications in an unlawful way or for any illegal or unlawful purpose(s). 

Request​ ​for​ ​Permission​ ​to​ ​Use​ ​Content.​ If you wish to use, publish or refer to any of our content, Course(s) or related materials, you must do so by requesting permission prior to commencing use of the same by email at enquiries@epicalglobal.com Permission is not granted until you receive such permission in writing.

Civil​ ​and​ ​Criminal​ ​Penalties.​ Even though our Courses are not physical property, you can be charged with theft or other face civil or criminal penalties if you copy, steal, infringe or otherwise violate these Terms. We reserve the right to prosecute infringers to the fullest extent allowed by criminal or civil statute in any jurisdiction allowed.


Your​ ​Materials​ ​and​ ​Contributions.​ By submitting a comment, photo, video or other material(s) onto any website or platform(s) owned or maintained by us, including but not limited to the online software platforms that we use to distribute our Membership, Services and related materials, you agree that we have a non-revocable, commercial license to republish your submission in whole or in part unless you explicitly state that we may not do so with said submission. You have no right to privacy by accessing our Membership or Course(s) or related materials, and we reserve the right to disclose your participation in the same. Please note this does NOT apply to data held under the virtual consultation services (see below).

Model​ ​Release.​ ​You must own the copyright to any image(s) you use in our Membership or related materials. You grant us a commercial license to any image(s) you submit to us by default, such as a Facebook profile photo or other profile image you voluntarily provide in accessing the Membership, or that you provide voluntarily upon our request. Such a default or voluntary release of your image and likeness may be used for any reasonable future business use. 
Notification​ ​of​ ​Use.​ ​We are not obligated to notify you or anyone of our use in our own publications of photographs or other images that you submit to us by default or voluntarily. 


  1. Medical Information provided “as is”

The content within our Membership or on any of the Platform(s) is provided for general information only.  It is not intended to amount to medical advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content provided by Epical Global Ltd.


Although we make reasonable efforts to update the content on our website, within our Membership or on any of the Platform(s), we make no representations, warranties or guarantees, whether expressed or implied, that the content on any of our Platform(s) is accurate, complete or up to date.

External Website Links

Where our website, Membership or Platform(s) contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.


We have no control over the content of those sites or resources.


  1. How we will treat your personal information

For the purposes of the General Data Protection Regulation (EU 2016/679) and the Data Protection Act 2018, Epical Global Ltd is the data controller with respect to personal data that you provide us through the Membership, in the purchase of products and services and the provision of Services on third party Platform(s).


We have a legal duty to treat all information disclosed by you through our Platform(s) as confidential and such information will only be processed in order for us to provide a safe Service.


We may make video and audio recordings of your Consultation, and retain transcripts of any emails, live chats or messaging in relation to any care and advice provided. These may be anonymised and made available to a third party for the purposes of improving services and/or developing services or products for improving safer care delivery. All data will be treated as confidential and will be securely held for as long as is legally required pursuant to all applicable regulations in the UK regarding data protection.


You agree that Epical Global may contact you through surveys for the purpose of quality control of the Services, improving the Services and general monitoring of the Services.


 

  1. Booking a virtual consultation

Epical Global Ltd utilises multiple platform(s) to provide our virtual consultation services.

You can use any of the Platform(s) to book a 20 minute video consultation with a Midwife, or other designated professional, with varying time duration. This will be explicit on booking. The Consultation will be carried out by video conferencing, phone call or live chat via the designated Platform.


Midwives will be available every day, with varying time slots for availability depending on your geographical location, the location of the midwife available and the type of appointment booked


All appointment times reflect the timezone which is specified in your Account settings. Always check that the correct timezone is set when booking or attending appointments.

 

Consultations or live chat sessions are subject to the availability of an appropriate healthcare professional. When you make an appointment we shall use all reasonable efforts to offer a Consultation within the timezone that you reside but we can give no guarantee that an appointment will be available in every timezone.  We cannot guarantee the availability of any individual healthcare professional.


A Consultation will be purchased via the Birth Like a Boss website or dedicated partner Platform(s).  Once payment has been made you will receive a confirmation email with clear instructions on how to register on the designated Platform.


At the time of booking your Consultation you will be asked to provide brief details of why you are accessing the Service as well as choosing an available time slot.


You will be required to verify your identity at the start of the Consultation – this can be done with any photo identification such as a driving license or passport. Neither the midwife or Epical Global will have any obligation to proceed with the Consultation if you are not able to verify your identity, and in such circumstances the midwife, or associated professional, may cancel the Consultation.


Please note that interruptions to the Service due to scheduled maintenance work by the third party providers may be beyond our reasonable control. We will endeavour to schedule appointment availability to work around routine maintenance work and ensure that such maintenance can be undertaken when access to our Services are least required.


Epical Global reserves the right to deny any person access to the Platform(s) or Service that behaves in an abusive or inappropriate manner towards any midwife, healthcare professional or other Epical Global staff. In such cases we reserve the right to terminate your use of the Platform(s) and access to any Services.


  1. Charges

The price of our Membership, courses, products or services will be set out on our Website or within the designated Platform(s) at the time of our commitment to provide the Services or products.


You are responsible for paying the prices as stipulated for any of the courses, products or Services (Charges). Charges will clearly show where additional taxes will be applied dependent on your country of residence. If you reside in the UK, charges will include VAT, unless otherwise stated.


Charges will clearly state whether they apply to a subscription or on a pay as you go basis.


Our Pay as you go Services are charged as follows:


Each single consultation, or package of consultations, shall be charged a flat fee which will be displayed to you before you confirm your purchase. In the event that you purchase a pay as you go fee for a set period of time, for example within the live chat feature, if the consultation lasts longer than the purchased time further charges may be applicable and you will be notified before the charges are applied.


Payments must be made at the time of purchase of the Consultation(s). We accept payment through Paypal or Stripe.


Our Subscription Services are charged as follows:

 

Subscriptions can be purchased for access to the Membership content, Services or a combination of both.  The subscriptions are for monthly or quarterly options and are payable up front in advance and cover a clearly specified limited number of consultations and access to specified content within the Membership site.


The subscription charges are clearly displayed on the website and associated Platform(s) and will be displayed to you at time of purchase before you confirm your Subscription.


We may offer a number of subscription plans, including special promotional plans or memberships offered by third parties in conjunction with the provision of their own products and services. Some membership plans may have differing conditions and limitations, which will be disclosed at the time you sign-up or in other communications made available to you.


Free or discounted trials

Your Membership may start with a free or discounted trial. The duration of the free or discounted trial period of your membership will be specified during sign-up and is intended to allow new members and certain former members to try the service.

Free or discounted trial eligibility is determined by Epical Global Ltd at its sole discretion and we may limit eligibility or duration to prevent abuse. We reserve the right to revoke the free or discounted trial and put your account on hold in the event that we determine you are not eligible. Members of existing organisations or recent membership are not eligible. We may use information such as method of payment or an account email address used with an existing or recent membership to determine eligibility. For combinations with other offers, restrictions may apply.

We will charge the subscription fee for the next billing cycle to your Payment Method at the end of the free or discounted trial period unless you cancel your membership prior to the end of the free or discounted trial period. Please note: as the discounted rates are very heavily discounted the fee is non-refundable  due to the cost of administration processes exceeding the amount charged.

 

Your card/payment details:

 

By inputting the details you are confirming that the debit/credit card being used is yours or that you have been specifically authorised by the owner of the debit/credit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery of the Services.

 

We reserve the right to cancel your purchase without prior notification (although we will let you know if this is the case as soon as possible) where your card details have been flagged by our fraud screening processes or are declined by our fraud screening processes.

 

You agree to promptly notify us of any changes to the payment method you provided while any Subscriptions remain outstanding. You are responsible for all applicable fees and charges incurred, including applicable taxes, and all Subscriptions purchased by you.

 

We do not store any whole credit card numbers or payment information, and instead, these are processed through third party processors such as Stripe or Paypal. By utilizing these payment processors to gain access to the Membership courses, products or Services you indemnify us and instead assume any and all risk or liability for the security of the payment details, and agree to be bound by the third party payment processor’s applicable terms and conditions of use. 

Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your purchase and payment secure, but unless we have not taken reasonable steps (and for the avoidance of doubt all steps that may be required by law) to prevent such unauthorised access, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when purchasing any products or Services.

 

  1. Cancelling or changing consultation bookings

You may cancel a one off Consultation up to 24 hours prior to the booked Consultation time and receive a full refund. If you cancel a Consultation less than 24 hours prior to the Consultation time, you will not be eligible for a refund.

 

Changing a consultation time:

 

You may rearrange a Consultation up to 24 hours prior to the Consultation time at no additional cost. If you wish to amend a Consultation less than 24 hours prior to the Consultation time, an administrative charge of £15.00 will be payable. (These charges are incurred as Epical Global will be reimbursing a midwife who is ensuring they are available for the booked Consultation time).

 

You should note that we will do our best to accommodate any changes but we cannot guarantee that a Consultation can be rearranged in a timeframe convenient for you, with a midwife who is available in your geographical location.

 

Please note the Consultation time is for 20 minutes and should you arrive late for your Consultation the appointment time will be reduced by the delay in your arrival.  In other words you will be given a specified time slot for your Consultation and it will end at the time specified regardless of when you were able to join. However, if you are unable to join the Consultation due to a fault in the Platform(s) which renders it unavailable, we will offer you a refund or an alternative Consultation at no extra cost.

 

Refunds

 

Fees for Membership, products and Services are set forth on the Website. We reserve the right to change these Fees at any time.


Refunds.  We offer a 14 day refund period for the purchase of our Courses or subscription services but whilst we want you to be satisfied with your purchase we also provide immediate access to the content within the Membership on receipt of payment, therefore in order to qualify for a full refund you must not have undertaken any part of the Course (s), or accessed any of the related materials.

In the event that you decide, prior to signing into the Membership or accessing a service, that it is not the right decision for you, within 14 days of purchase you can contact our support team at enquiries@epicalglobal.com and let us know that you are requesting a refund.


We will NOT provide refunds more than 14 days following the date of purchase. After day 14, all payments are non-refundable and you are responsible for full payment of the fees for the Membership or service regardless if you complete any or all of the Course (s) or accessed content.

In exceptional circumstances, on presenting proof of these circumstances, a refund may be processed for 75% of fees only if a Course was paid for in full and only if the full price of the Course was paid. This will apply if you have signed into the Course and completed one module only. If more than one module has been accessed and completed no refund will be given. You can contact our support team on enquiries@epicalglobal.com to inform us of the exceptional circumstances and request the refund.  Please note: “exceptional circumstances” will be defined and accepted by Epical Global Ltd only.


Please note that we do not refund part payments if you decide to cancel your subscription part way through the month. Please see further details on termination of your subscription below.


Chargebacks. You agree to make every attempt to request a refund prior to attempting a chargeback with your financial institution. In the event of a chargeback attempt, you expressly agree to forfeit any and all of our related materials afforded to you for the original purchase of our Membership. We reserve the right to present proof of your access and these Terms to the financial institution investigating the dispute.

This does not affect your consumer rights in respect that any element of the Membership or Course(s) or related materials that are defective.


Refunds will always be in Great Britain Pounds. If there is a currency fluctuation, this will affect the amount of the refund.

We offer refunds on the basis of the “good faith” principle. This means that we trust that you will not download all downloadable materials and then ask for a refund.

Please note that our system shows us what materials you have downloaded. We hold the right to refuse a refund in case we are convinced that this policy is being abused.

In case you have received a refund, you will be required to delete all the downloaded materials from your hard drive.


Termination

 

For individual use: As access to the Membership and Courses are for a limited time period it is anticipated that your rights to termination will not be required. In the event that should you wish to do so you have the unilateral right to terminate your use and access to any of our Course(s)material. Please send an email enquiries@epicalglobal.com to initiate the process. Termination will not excuse you of further payment. Upon confirmation of your termination, any and all outstanding balances will become immediately due and payable.  Any existing balance that remains after 14 days from the date of termination will be sent to a collections agency, and you agree to be responsible for any additional charges, fees or costs associated with such a collection effort, including but not limited to reasonable legal costs.

 

  1. Our Midwives and other Healthcare Professionals

Our midwives and any other healthcare professional providing our Services will be registered with their professional bodies in their country of residence.

 

In the UK, midwives will be registered with the Nursing and Midwifery Council.

 

In addition they are specifically insured to provide the virtual Services.

 

COVID 19 exclusions – please note that due to Covid 19 there are specific exclusions within the insurance policy relating to Communicable diseases: see wording below

 

any Claim arising out of or resulting from, directly or indirectly, in whole or in part, any actual, alleged or suspected:

 

  1. transmission of any:

 

  1. Scheduled Communicable Disease; or

 

  1. Communicable Disease, which constitutes a Pandemic;

 

by (i) an Insured, (ii) an independent contractor who is providing services to, for, or on behalf of an Insured, (iii) a patient, or (iv) a visitor, to any other person;


A virtual consultation with an Epical Global healthcare professional may not always be sufficient for your needs and is unlikely to be appropriate or sufficient in certain cases. These include, but are not limited to:


  • Emergency situations
  • Where a physical examination is likely to be required
  • Where a physical intervention is likely to be required
  • If you are in labour or giving birth


The information and advice provided by an Epical Global healthcare professional during a Consultation, email exchange or live chat process, is based on the information you have supplied either before or during the session. It is your responsibility to ensure that the information you provide is correct and complete and you accept that your failure to do so (whether intentionally or not) may affect the information and advice that is given to you, and as such, may have consequences for which we are not responsible.


If you do not fully understand the advice or information given during a Consultation or live chat session, it is your responsibility to raise this during the session with the healthcare professional.


Epical Global Ltd does not directly employ midwives or healthcare professionals and they remain independent practitioners who are sub contracted to provide the Services. We take all reasonable steps to verify the identity of independent healthcare professionals and to verify appropriate background information but Epical Global makes no representation or guarantee in relation to, and is not responsible for, the qualifications of any Epical Global sub-contractor who is not an employee.


If, following a Consultation or Session, you are in any doubt, or have any concerns regarding any advice you have received or failed to receive, or regarding your health, wellbeing or any conditions, you are responsible for seeking further medical advice from a suitable healthcare professional not sub contracted or affiliated with Epical Global or for using emergency services where appropriate.


  1. Medications and Prescriptions

Midwives in their respective countries will be able to advise on specific medications, relevant to pregnancy, labour and birth and the postnatal period but please note that midwives will not PRESCRIBE any medication and will only be able to advise on use.

 

The cost of any medication advised is not covered by your Consultation.

 

  1. Referral and signposting

Epical Global virtual midwife consultation services do NOT replace your existing care provision and should only be used to complement your existing care. Epical Global may not be a referrer in your country of residence and therefore cannot refer you directly to a specialist but may advise on the most appropriate speciality or specialist.

 

Epical Global is not responsible for any costs of or relating to such advice and it will be your responsibility whether you access any ongoing specialist care.

 

  1. Our responsibility for loss or damage suffered by you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our contractors or employees, for fraud or fraudulent misrepresentation and a breach of the terms implied by the Consumer Rights Act 2015.

 

Please note our third party Platform(s) and Services are only provided for domestic and private use. You agree not to use any Platform or Service for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

Epical Global is not liable for any delays that are outside of our control in the provision of the Service. However we will take all available steps to minimise the effect of any delay. Provided we have done this, we not be liable for any delays.  If the delay is significant we may offer you’re the option of cancelling the Service and receiving a refund or rearranging the Consultation at no additional cost.

 

We are liable to you for loss or damage if it was a foreseeable result of breaking these Terms or our failing to use reasonable care and skill up to a maximum of £1,000,000. However, we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is so obvious that it will happen or if, at the time you accepted these Terms, both we and you knew it might happen.

 

The Platform(s) and Services are designed to keep your personal health data secure and it is important that you follow the instructions and advice in these Terms or otherwise made known to you in order to keep your data safe. We are not liable for loss or unauthorised access to your data where it results from you not following such instructions and advice.

 

The Platform(s) and Services have not been developed to meet your individual requirements. Please check that the facilities and functions of the designated Platform and Services meet your requirements.

  1. We are not responsible for any viruses (not healthcare related) and you must not introduce them

We do not guarantee that any Platform(s) that we use will be secure or free from bugs or viruses.

 

You are responsible for configuring your information technology, computer programmes and platform to access our Platform(s). You should use your own virus protection software.

 

You must not misuse any Platform(s) that are used by use to deliver our Services by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to any Platform(s), the server on which the Platform(s) are stored or any server, computer or database connected to the Platform.  You must not attack any Platform(s) via a denial of service attack or distributed denial of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use any Platform or Service will cease immediately.

 

  1. Linking to our site

You may link to our website, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

 

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

 

You must not establish a link to our website in any website that is not owned by you.

 

We reserve the right to withdraw linking permission without notice.

The website or Membership site many contain links to other websites and resources provided by third parties. These sites are not under our control and we are not responsible for and do not endorse their content or their terms and conditions or privacy policies (if any). You will need to make your own independent judgement regarding your interaction with any other sites, including the purchase and use of any products or services accessible through them.

 

  1. Which Country’s laws apply to any disputes?

These Terms, their subject matter and their formation, are governed by English law. We both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland or Scotland you may also bring proceedings in these respective countries.

 

  1. General

Any notices you give us must be in writing by email in the first instance or by post using the address provided at the start of these Terms. We will give notice by email using the information you provide to us upon registration of any Platform(s).

This agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

 

If any part or parts of these Terms shall be held unenforceable for any reason, the remainder shall continue in full force and effect. If any provision of these Terms is deemed invalid or unenforceable by any court of competent jurisdiction, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as limited.

 

You may only transfer your rights or obligations under these Terms to another person if we agree in writing. We may transfer our rights and obligations under these Terms to another organisation. We will always give notice if this happens and we will ensure that the transfer will not affect your rights under the contract.

 

Even if we delay in enforcing these Terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
